Welcome to Total Detailing LLC ( “Total Detailing,” “TD,” “we,” “our,” or “us”). These Terms of Service (the “Terms”) form a legally binding agreement between you (“you” or “User”) and Total Detailing LLC governing your access to and use of:

  • our websites located at https://totaldetailingpa.com and any sub‑pages we operate (collectively, the “Site”),

  • all in‑shop, on‑site, and mobile detailing, paint‑protection, ceramic‑coating, and related vehicle‑care services that we perform (together, the “Detailing Services”), and

  • any electronic communications we send or receive, including SMS/Text Messaging (the “TD Text Alerts Program,” see § 14).

By accessing or using any part of the Site, booking or receiving Detailing Services, or opting in to the TD Text Alerts Program, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the Site, the Services, or the TD Text Alerts Program.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use our Services. By using the Services, you represent that you meet this requirement.

2. Changes to Terms or Services

We may modify these Terms or any aspect of the Services at any time. Material changes will be announced by: (i) posting an updated version on the Site, and/or (ii) sending notice by email or SMS. Continued use of the Services after the effective date of an update constitutes acceptance of the revised Terms.

3. Accounts & Booking 

Creating an online booking account is optional but, if you do:

  • Provide accurate, current information.

  • Maintain the confidentiality of your login credentials.

  • Promptly update any changes. You are responsible for all activity under your account.

4. Pricing & Payment 

Prices are quoted in U.S. dollars and may change without notice until you book an appointment. Payment is due at service completion unless different terms are stated in your invoice. We accept the payment methods listed on the Site. Returned‐payment fees and late‑payment interest (1.5 % per month or the highest rate allowed by law) may apply.

5. Cancellations & Rescheduling 

You may reschedule or cancel up to 24 hours before your appointment with no fee. Cancellations inside 24 hours or no‑shows may incur a fee up to 25 % of the quoted service price.

6. User Conduct 

You agree not to:

Use the Site or Services for any unlawful purpose.

Attempt to gain unauthorized access to our systems.

Send harmful code, spam, or interfere with network operation.

Misrepresent your identity or vehicle ownership.

We may refuse service or terminate your account for violations.

7. Intellectual Property 

All content on the Site (text, graphics, logos, photos, videos, software) is owned by or licensed to Total Detailing and protected by U.S. and international intellectual‑property laws. We grant you a limited, non‑exclusive, non‑transferable licence to access and use the Site for personal, non‑commercial purposes. You may not copy, distribute, create derivative works from, or publicly display any portion of the Site without our prior written consent.

8. Third‑Party Links 

Our Site may contain links to third‑party websites or services we do not control. We are not responsible for third‑party content, privacy practices, or services.

9. Disclaimers 

Services “AS IS” – Except as expressly stated, the Site and Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not guarantee that the Site will be uninterrupted or error‑free.

10. Limitation of Liability 

To the fullest extent permitted by law, Total Detailing’s total liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of (a) USD $500 or (b) the amount you paid us for the specific service giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or loss of goodwill) resulting from or related to your use of the Services.

11. Indemnification 

You will defend, indemnify, and hold harmless Total Detailing and its owners, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your (a) use of the Site or Services, (b) violation of these Terms, or (c) violation of any rights of another.

12. Dispute Resolution & Arbitration 

Any dispute arising from these Terms or the Services will be resolved exclusively by binding arbitration in Montgomery County, Pennsylvania, under the Commercial Arbitration Rules of the American Arbitration Association, except that either party may bring an individual action in small‑claims court. You and TD waive any right to a jury trial or to participate in a class action.

13. Governing Law 

These Terms are governed by the laws of the Commonwealth of Pennsylvania without regard to its conflict‑of‑laws rules.

14. TD Text Alerts Program (SMS/MMS)

This Section supplements § 3 and applies when you opt in to receive SMS or MMS messages from us.

14.1 Types of Messages – Appointment confirmations, reminders, vehicle‑ready notices, service recommendations, limited‑time promotions, and customer‑care replies.

14.2 Opt‑In Methods (Written Consent Required)  a. Website checkbox (unchecked by default) using the exact language in § 14.7 (a).  b. Email reply “YES” using § 14.7 (c).  c. Verbal script in § 14.7 (b).  Records of consent are retained for audit.

14.3 Frequency & Fees – Messaging frequency varies (up to 8 messages per month). Message and data rates may apply.

14.4 Opt‑Out & Help  a. Text STOP, END, CANCEL, or UNSUBSCRIBE to 484‑854‑1447 to stop. You will receive: “Total Detailing LLC: You’re unsubscribed and will receive no further texts. Reply START to re‑subscribe.”  b. Text HELP to 484‑854‑1447 for: “Total Detailing LLC support: email shine@totaldetailingpa.com or call 484‑854‑1447.”

14.5 Carrier & Delivery – Delivery not guaranteed; carriers are not liable for delayed or undelivered messages.

14.6 Privacy – Phone numbers and SMS consent are never shared with third‑party marketers. See our Privacy Policy for full details.

14.7 Required Consent Language (for your reference)

15. Severability & Waiver 

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of future enforcement.

16. Entire Agreement 

These Terms and the documents referenced herein constitute the entire agreement between you and Total Detailing regarding the Services, superseding all prior agreements.
